This Month’s Topic
In this program, you’ll learn about the July 2019 amendments to New Jersey’s Medical Marijuana law and how it affects the workplace, specifically, imposing prohibitions on discrimination and reasonable accommodation obligations. The prior version of the law did not impose any obligations on employers, expressly stating that employers were not required to accommodate medical use of marijuana in the workplace. You’ll learn what is specifically required in the accommodation process including the intersection of disability accommodation and medical marijuana use. The program will also cover what “adverse employment action” means and how to protect the company from wrongful discharge claims while ensuring all employment decisions are legitimate and non-discriminatory. The program will also provide guidance and framework for employers who conduct workplace drug testing in light of the new law and changes that needs to be made to employer policies.
